TERMS AND CONDITIONS
Please read these Terms and Conditions thoroughly. Any work carried out by Canvas Print Shop Ltd ( canvas-print-shop.co.uk ) is based on the understanding that these terms are understood and accepted by the customer. All orders are subject to these terms and conditions and your acceptance of them is expressed by completing the online order form including ticking the Terms and Conditions box.
Applicable Law
Canvas Print Shop Ltd is registered in England , and every sale shall be deemed to be performed in England ; English law shall govern each transaction, including (without limitation) all contractual and other relationships, which arise as a result of such sales. You and we submit to the non-exclusive jurisdiction of the English courts in relation to any disputes arising out of any sale.
Copyright
All copyright, design rights and intellectual property rights existing in our designs and products and in the images, text and design of this website / marketing material are and will remain the property of Canvas Print Shop Ltd. Any infringement of these rights will be pursued vigorously. Canvas Print Shop Ltd. shall not be required to print any matter, which in its opinion is or may be of an illegal, immoral or libelous nature. It is the responsibility of the customer to ensure that all material presented for photography, printing, copying, duplicating or any other form of reproduction is free from any third party claims for breach of copyright or license. Canvas Print Shop Ltd. shall be indemnified by the customer in respect of any claims, costs and expenses arising out of any libelous matter printed for the customer or any infringement of trade marks, copyright, patent or design.
We reserve the right to use any Canvas Print Shop... uploaded images and final prints/canvases for our own advertising purposes. We will not, under any circumstances, use them for resale except where an agreement exists under the terms of our Partnership Opportunity scheme.
By using this site you agree that you have been authorized by the owner of any images you upload, email or post to Canvas Print Shop Ltd, to make and use a reproduction onto other media using their image(s).
You accept that the images and designs used on the canvas-print-shop.co.uk website are the property of Canvas Print Shop Ltd. or their respective copyright owners, and are used by canvas-print-shop.co.uk pursuant to express authorization from copyright owners or their agents. You acknowledge that all copyright, trademarks and other intellectual property rights in and relating to canvas-print-shop.co.uk are vested in canvas-print-shop.co.uk or our partners where appropriate. You must not use, reproduce, modify or distribute our images or any part of those images in any manner, whatsoever. In the event that there is any dispute between us in relation to this issue, you agree that until the matter is resolved, an interim injunction will be an appropriate remedy. An Interim injunction is a court order, which would prevent any further use or distribution of the image that we are concerned about, until a final court hearing where the court will make a decision on all the facts.
Creating a contract with us
When making a transaction with canvas-print-shop.co.uk we ask that you agree to register using your correct name, address and any other requested details. You may be asked to enter credit, debit or charge card details. You must ensure that (a) you are fully entitled to use that card at the time when you provide those details to canvas-print-shop.co.uk and b) the card has available funds to cover all charges incurred on it in the course of purchasing from us. If any of the information you enter becomes incorrect or is superseded, then please notify us with the corrected information immediately. In any event, to register for canvas-print-shop.co.uk services, you must legally be able to enter into contracts for goods and services that you may buy here. Generally, this means that you must be at least 18 years old. Canvas Print Shop Ltd will return your original material (except where that material is obscene and has been rejected) along with your completed order and whilst every step will be taken to safeguard it, you send it to us at your own risk and we shall not be liable for any loss or damage caused to it during transit or by another reason beyond our control. We shall not be liable for any intrinsic value beyond the basic value of the material upon which your original is produced. Orders can be placed 365 days a year, 24 hours a day, but will only be processed during working hours. Canvas Print Shop Ltd operates working days of Monday to Thursday 9 am - 5 pm. Canvas Print Shop Ltd closes on Bank Holidays and between Christmas and New Year.
Payment
Our preferred method of payment is by credit/debit card via Paypal. We will also accept payment by cheque or BACS (direct bank transfer). Customers are required to pay the full amount including any delivery charges. Work will begin on receipt of cleared payment.
Security and Privacy
We know you're concerned about security and privacy. We want to reassure you that any information you give us during the registration or ordering process as well as any that we know about you by other means will be well protected. We also feel it is important that you know exactly how any information you give us is used and that all information is collected lawfully and in accordance with the Data Protection Act 1998.
The privacy policy forms part of the agreement between us, and by purchasing goods from our site, you agree to be bound by the terms and conditions of the agreement between us. You also give your consent to the way we may handle your personal data in the way stated in this policy statement. canvas-print-shop.co.uk will not use this data, or disclose it to any other party, either during registration or at any other time, without your express permission, given during registration or at some other time.
We may also contact you in respect of special offers or competitions, but only if you have elected to receive this by checking the opt-in box during the registration procedure or competition entry page, or entered your email address on the home page mailing list submission. To provide a service that meets our customer needs, we may collect personal data relating to the popularity and usage of particular aspects of the site or related canvas-print-shop.co.uk sites. However this data will be used or aggregated only on an anonymous basis.
Any credit card information you provide is processed through our payment gateway (Paypal) and is subject to their stringent security protocols and their terms and conditions. No credit/debit card details are processed directly through our own web-site canvas-print-shop.co.uk
Prices
Prices are as stated on the website at the time of ordering. We reserve the right to alter our prices without prior notice. Additional work carried out at the customer's request, will be charged accordingly.
Gift Vouchers
Gift vouchers may only be used to purchase products/services supplied by Canvas Print Shop Ltd. and can not be exchanged for cash or refund or used against postage and packaging charges. Vouchers are non transferable. Only one voucher may be redeemed per order. Please note vouchers expire 12 months after the date of issue. Please contact us after this date.
Tax & Duties
For purchases made to be delivered outside the European Union, you will automatically be responsible for paying all applicable taxes and duties.
Delivery
Canvas Print Shop Ltd. will endeavour to dispatch your goods to you within 7 to 10 working days of receipt of your image/ order. Every effort will be made to deliver on time, but any delivery day specified is a best estimate and no liability is accepted for any loss arising from delay or error in the delivery of the goods. Any delay by the customer in responding to the proofing e-mail will cause a corresponding delay in fulfilling the order. When payment is by cheque the ordering cycle will be deemed to start from the point where payment clears into our account. Canvas Print Shop Ltd reserves the right to deliver within 21 days of receipt of order if dictated by unforeseen circumstances, after which time the option of a full refund is available.
Reproduction Quality
Canvas Print Shop Ltd cannot accept any responsibility for quality issues other than those arising from faulty manufacturing or printing. The quality and composition of the supplied original is the responsibility of the customer and goods will not be replaced due to issues arising from the nature of the original.
We offer a preview service to enable our customers to view the final image prior to printing; the preview service is intended to give a reasonable representation of the final image for composition purposes mainly. Due to variables within the reproduction process, we cannot guarantee an exact recreation of the colour balance of either the original image or the on screen proof.
Returns Policy
Canvas Print Shop Ltd operates a full and fair returns policy. Your rights to return goods are protected under the EU Distance Selling Directive which can be found at http://www.opsi.gov.uk/si/si2000/20002334.htm
Under the Consumer Protection (Distance Selling) Regulations 2000 any unused product purchased through our site can be returned within 7 days from the date of receipt for a 100% refund, if in its original condition and in the original packaging.
The only exception to this is for the supply of goods made to the consumer's specifications or clearly personalized or which by reason of their nature cannot be returned or are liable to deteriorate or expire rapidly; or have been custom-made to order , in which case we are unable to except returns .
Canvas Print Shop Ltd. wants all its customers to be totally satisfied with their goods. Your canvas is guaranteed to be free of any manufacturer's defects. If such defects exist or goods have been damaged in transit you must notify us within 24 hours of receipt , or the following Monday morning if your order was delivered on a Saturday.
If a parcel is returned to Canvas Print Shop Ltd by the couriers, we will arrange for the collection and return at a cost of *£15.00. This covers the cost charged by the couriers of returning the parcel to Canvas Print Shop Ltd and redelivering to the customer. Redelivery will not be made until payment is received.
All we ask is that you pay the cost of returning the goods to us via the same method we used to originally dispatch the goods to you. Customers are solely responsible for the safe return of goods undamaged.
We will carry out an inspection of all returned prints and originals to check for signs of use (scratches etc) that would prevent us from reselling them as new. If the goods are in mint condition, a 100% refund will be issued. If payment has been received in advance we guarantee to refund your money within 30 days of receipt of the returned goods.
*Additional charges apply for Northern Ireland , Scottish Highlands , Isle of Wight, Off-shore Islands and Channel Islands .
Customer Responsibilities
Customers are responsible for providing information completely and accurately. Extra care should be taken when giving special instructions. Canvas Print Shop Ltd. will not be responsible for incorrect orders due to incorrect customer instructions. Verbal instructions are accepted on the basis that Canvas Print Shop Ltd. will not be held responsible for any error that may arise.
Loss
Please be aware that we will not be liable to you or any third party for any indirect costs or loss or damage, or for any loss of data, profit, revenue, business or management time, howsoever caused. You also agree that the liability of Canvas Print Shop Ltd. under this agreement (whether arising in negligence or otherwise), will not under any circumstances exceed the greater of a) £500 or b) an amount equal to the sums paid or payable by you.
This does not affect your statutory rights as a consumer.
Consequential Loss
In the event of consequential loss, Canvas Print Shop Ltd. will only be responsible for the cost of your order.
General
Descriptions of goods and services included in the canvas-print-shop.co.uk web-site are accurate to the best of our knowledge. We do our best to correct errors or omissions as soon as we are aware of them. However, you should know that the colours and appearance of images, mounts and frames may vary very slightly from the way they appear on the screen. Also print sizes can vary slightly with each production run.
canvas-print-shop.co.uk shall not be liable for any failure to perform its obligations under this agreement if caused by matters beyond our reasonable control.
canvas-print-shop.co.uk reserves the right to change the terms of this agreement from time to time, and post a new version on our website. The new version will take effect from the day of posting on the site. Price and availability information are also subject to change without notice.
Severability
In the event that any term of this agreement is held to be unenforceable or invalid by judicial decree or decision, the remainder of this agreement shall remain valid and enforceable.
